Terms of Service

These Terms apply to all visitors, users, and others who access or use the Service. Your continued use of Archivist AI, EverAfter, or any related feature confirms your acceptance of these Terms.

The Service includes:

• Archivist AI: tools for TTRPG session transcription, campaign tracking, generative summarization, and world-building support.
• EverAfter: a gift-recommendation and preference-management product integrated with the Company's platform.

Both services operate under the same account system, infrastructure, and legal entity and may share supporting features, data flows, and integrations.

You must be at least eighteen (18) years old to create an account and use the Service. By creating an account you represent and warrant that you are of legal age. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. Notify us immediately of any unauthorized use or breach of security.

4.1 Subscription Period

Some features of the Service require payment of a recurring subscription ("Subscription"). The billing cycle (monthly, annually, etc.) is as selected when you purchase the Subscription. At the end of each period your Subscription automatically renews unless you cancel or we terminate.

4.2 Cancellation

You may cancel the renewal of your Subscription through your account settings or by contacting us. You will retain access to the Service until the end of your current paid period. Paid Subscription fees are non-refundable except as required by law.

4.3 Fee Changes

We may change Subscription fees at our sole discretion. We will provide reasonable prior notice of any changes and such changes will apply at the next billing cycle. Your continued use of the Service constitutes acceptance of the fee change.

4.4 Add-Ons

For features or credits beyond standard plans (such as extra sessions, image credits, or gift-recommendation credits), the same billing, cancellation, and refund rules apply unless otherwise specified.

5.1 Ownership of Content

You retain ownership of all content you upload or generate using the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, display, perform, adapt, and distribute Your Content as necessary to provide and improve the Service, comply with legal obligations, and maintain platform integrity.

5.2 Acceptable Use

You agree not to use the Service for any illegal or unauthorized purpose. You will abide by all applicable laws and will not upload, distribute, or transmit content that is unlawful, infringing, defamatory, or otherwise harmful. The Company's Content & Usage Policy applies to all public-sharing features.

5.3 EverAfter Specific Data

When using EverAfter, you may provide additional data such as gift preferences, recipient details, style or aesthetic information, and shopping-intent data. You acknowledge that this data is used by the Service to generate personalized gift recommendations and may be stored, processed, and used in accordance with our Privacy Policy.

The Service (excluding Your Content) and all rights therein, including but not limited to software, code, designs, features, trademarks, and trade dress, are owned by the Company and/or its licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works of the Service without our prior written consent.

The Service may include links to third-party websites or services. We are not responsible for their availability, security, or content, and you use them at your own risk. Any transactions you enter with third parties are solely between you and the third party.

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including payment obligations, intellectual property, and disclaimers) will continue to apply.

To the maximum extent permitted by law, the Company's liability under these Terms is limited to the amount you paid to us for the Service in the twelve (12) months preceding the claim, or one hundred US dollars (USD $100) if you have not paid us. In no event shall the Company be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service.

The Service is provided "AS IS" and "AS AVAILABLE," without any warranties of any kind, whether express, implied, or statutory. We do not guarantee that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law provisions. You agree that any dispute relating to or arising from these Terms or your use of the Service shall first be submitted to us for informal resolution. If still unresolved, the parties may pursue any legal remedies available.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. No waiver of any term shall be deemed a further or continuing waiver of that or any other term.

We may modify or replace these Terms at any time. If we make material changes, we will provide notice through email or a prominent posting within the Service. Your continued use of the Service after those changes constitutes acceptance of the new Terms.
